Terms & Conditions

Terms & Conditions: Wedding Planning, Event Management & Day of Coordination Services

Deposits

  • A non-refundable deposit of 50% of the estimated total fee is due on booking to confirm the date.

  • This deposit will be deducted from the final invoice, unless other arrangements have been made.

  • The final payment of the remaining 50% of the total fee, plus any associated travel costs, is due 90 days ahead of your event day.

  • Bookings will only be deemed as confirmed once the deposit has been paid and event contract has been signed and returned.

 

Additional Costs

  • Any additional charges (including but not limited to breakages, additional staff hours, additional hire equipment, additional event related purchases such as stationery etc.) will be invoiced at the end of each month or directly following your event and payable 7 days from the date of invoice.

  • Any parking or travel fees that are in addition to what has been estimated will be added to the invoice for payment.

  • Travel costs may apply depending on your event details and will be quoted as accurately as possible ahead of time by With Love. Travel is generally charged at the standard $1 + GST per km. If the travel time is more than 90 minutes, accommodation may be required for the evening. Bookings on Waiheke Island may incur additional travel costs such as mileage, parking, ferry tickets and travel time. This will be quoted on booking.

  • On the day of the event, as your Wedding Planner, Event Manager or Day-of-Coordinator, there may be times where With Love is required to resolve an urgent issue which may incur unexpected costs. For example, should there be a power cut which requires an electrician to come and fix it or perhaps a vendor falls ill on the wedding day, and we need to find a last-minute replacement for them. In these situations, With Love will liaise with you as the client (where possible) to indicate additional costs. With Love will arrange for the invoice to be passed onto you for direct payment.

  • At times, communication and arrangements required for the event (i.e. with the venue, catering companies, event management etc.) will be managed directly by With Love on the clients behalf. The scope of this will be agreed in with you as the client in advance depending on the services you have selected. 

 

Change of Date

  • Should you require a date change for your booking, With Love will apply the balance of a client deposit and prepayments minus a $750 inconvenience fee towards another event, subject to With Love's availability, when being notified at least 6 months prior to the original event date. All costs quoted will be subject to change except in the event of force majeure. The deposit is non-refundable if the booking is cancelled or changed past the 6-month notification mark.

 

Intellectual Property

  • Any content developed and provided by With Love remains the property of With Love. Any information (including, but not limited to - run sheets, floor plans, proposals, pricing, vendor tips, hire list, budgeting templates, ceremony scripts, vow examples, etc.) shared with you as the client must remain confidential and is not to be shared with others without getting prior written consent from With Love.

 

Other Vendors

  • With Love does not accept any commissions from recommended vendors and cannot guarantee any service providers performance or product. 

  • With Love will forward all related contracts and invoices to you as the client to review, sign, and arrange payment. 

  • If With Love recommend that you engage a third party to provide you with goods or services, With Love do so on the basis that With Love do not accept any liability whether in contract, equity, tort (including negligence), an enactment or otherwise in relation to that assistance or recommendation.

  • The performance of requirements under any contract entered by you as the client will not bind With Love to the terms of that contract. However, With Love may, from time to time, be required to perform and/or manage contracts if necessary. When oversight and/or management is required, you will be made aware of the specific management and/or oversight details required by With Love to ensure the event day progresses as planned. To avoid any doubt, With Love will assist, but you (as the client and as a party to that contract) will remain liable in full under the terms of the contract(s) which you have signed.

  • You as the client will make direct payments to the service provider and NOT to With Love.

 

Assignability

  • This contract is not assignable without prior written consent of With Love. 

 

Storage and Handling

  • At times, With Love may store or handle your event items on your behalf. If this is the case, all items must be collected by you as the client, no later than seven days after your event day. With Love will assume no responsibility for any loss or damages to stored items.

 

Cancellation of Booking

  • Should you as the client decide (for whatever reason) to cancel your booking, you are required to provide written notice of the cancellation. There will be no refunds of the deposit due to the reservation of the event date (unless otherwise agreed). In addition, there shall be no refund to any additional payments made and will be considered payment for services rendered to date.

  • Where any bookings, orders and/or contracts have been secured; and where invoices or debts have been incurred, or have been issued prior to the notice of cancellation, you must promptly pay these invoices and debts.

  • Where work has been completed and the payments made to date do not cover the hours invested by With Love, an additional invoice will be issued to include the hours of work which have not yet been paid for. Payment of this invoice will be payable within 7 days of the invoice date.

  • If written notice of cancellation of Services is not provided by the Client, the Client shall be responsible for full payment of Services, including travel fees (if applicable).

  • In the event of past due or non-payment of fees as outlined in the Payment Schedule (included in your event contract), With Love reserves the right to cease services until the account is brought current.

  • With Love reserves the right to terminate this booking by written notice for any accounts past due 30 days. In the event of cancellation by With Love due to non-payment of fees by the Client, all payments made to With Love by the client will be considered payment for services to date.

 

Damage

  • With Love assumes no responsibility for ANY damage or loss of merchandise, alcohol, equipment, furniture, clothing or other valuables prior to, during, or after the event.

  • The client understands that accidents/breakage and/or damage may sometimes occur. With Love will not be liable for any damage or loss, unless specifically caused by the negligent actions or conduct of With Love or its employees.

 

With Love Liability

  • Maximum Liability: To the extent permitted by law, in relation to any claim against With Love arising from any cause (whether based in contract, equity, tort (including negligence), an enactment or otherwise), the aggregate liability of With Love is limited to the price (excluding GST) paid by the client in relation to the products and services giving rise to the claim (excluding GST).

  • Multiple Claimants: If more than one person has a claim against With Love, the limit in the clause above is the aggregate liability of With Love to all such claimants.

  • Consequential Losses: With Love shall not be liable for consequential losses. 

  • Limitation Period: The Limitation Act 2010 (“Limitation Act”) is modified to the effect that any claim must be filed within 6 months of the date of the act or omission on which the claim is based (“Limitation Period”). The Limitation Period applies even if the Client does not have knowledge of the act or omission, and/or any other related facts, until after the expiry of the Limitation Period and no “late knowledge” extension (for example, under section 11(2), 11(3), 14 or 32(2) of the Limitation Act) shall apply.

 

Client Liability

  • The client agrees to indemnify With Love from all claims suffered and costs, including legal costs on a full indemnity basis and/or solicitor/client basis and all debt collection and/or debt collector’s costs, losses, expenses and/or damages incurred by With Love by reason of client default in observing or performing client obligations under this agreement.

 

Unlawful Activity

  • The client and With Love or its employees will comply with all legal compliance requirements including: health and safety, lawful orders of police and/or fire services and will not do anything on the event premises in violation of any laws, rules or orders.

  • If unlawful activities should occur on the premises by the client and/or event guests and the event is cancelled, there will be no refund of any kind from With Love to the client.

 

Amendment & Supplement

  • Any amendment and supplement to this agreement shall come into force only after a written agreement is signed by both parties fourteen (14) days before the event date. The amendments and supplement duly executed by both parties shall be part of this agreement and shall have the same legal effect as this agreement.

 

Force Majeure

  • Means any or all, but is not limited to Acts of God or public enemy, flood, earthquake, storm, cyclone, fire, explosion, war, riot, strikes, pandemic. In the unfortunate event of force majeure, either party must give notice as soon as possible after the force majeure event occurred. If a Force Majeure Event prevents With Love from providing the agreed services, With Love shall, without limiting its other rights, provide a credit of any payments made to be used on an alternative date within a 12-month period of the initial event date. Standard terms and conditions apply once an alternative date is confirmed.

 

Covid Policy

  • Should a nationwide or Auckland lockdown restriction be put in place, where the client is not able to have their event, any and all payments made to With Love will be credited to an alternative date within 12 months of the original date. Normal terms and conditions will apply to the new date.

  • Should a government mandate for nationwide or Auckland specific restriction(s) be put in place, With Love will still require the client to proceed with their event if:

    • Their contracted attendee numbers are permitted by the Government restricted occupancy levels at the time of their event.

    • With Love can comply with all operating standards detailed by the Government.

  • With Love requires the client and all attendees to comply with all operating requirements it may have adopted as a result of the Government restrictions at the time of their event. This may include but won't be limited to, all health and safety measures, social distancing, mask wearing, and or adopting a Vaccination Mandate that requires all attendees, including staff, to be fully vaccinated, and to be able to provide government accredited evidence of such.

Terms & Conditions: Celebrant Services

Deposits

  • A non-refundable deposit of 50% of the estimated total fee is due on booking to confirm the date.

  • This deposit will be deducted from the final invoice, unless other arrangements have been made.

  • The final payment of the remaining 50% of the total fee, plus any associated travel costs, is due on completion of your first draft ceremony script and at least 14 days ahead of your wedding day.

  • Bookings will only be deemed as confirmed once the deposit has been paid and wedding contract has been signed and returned.

 

Additional Costs

  • Any additional charges (including but not limited to breakages, additional hours, additional hire items or purchases such as stationery or vow books etc.) will be invoiced at the end of each month or directly following your wedding and payable 7 days from the date of invoice.

  • Any parking or travel fees that are in addition to what has been estimated will be added to the invoice for payment.

  • Travel costs may apply depending on your event details and will be quoted as accurately as possible ahead of time by With Love. Travel is generally charged at the standard $1 per km. If the travel time is more than 90 minutes, accommodation may be required for the evening. Bookings on Waiheke Island may incur additional travel costs such as mileage, parking, ferry tickets and travel time. This will be quoted on booking.

 

Change of Date

  • Should you require a date change for your booking, With Love will apply the balance of a client deposit and prepayments minus a $250 inconvenience fee towards another event, subject to With Love’s availability, when being notified at least 6 months prior to the original event date. All costs quoted will be subject to change except in the event of force majeure. The deposit is non-refundable if the booking is cancelled or changed past the 6-month notification mark.

 

Intellectual Property

  • Any content developed and provided by With Love remains the property of With Love. Any information (including, but not limited to - run sheets, proposals, pricing, vendor tips, budgeting templates, ceremony scripts, vow examples, etc.) shared with you as the client must remain confidential and is not to be shared with others without getting prior written consent from With Love.

 

Other Vendors

  • With Love does not accept any commissions from recommended vendors and cannot guarantee any service providers performance or product. 

  • Where With Love is supporting you to arrange wedding vendor bookings, With Love will forward all related contracts and invoices to you as the client to review, sign, and arrange payment. 

  • If With Love recommend that you engage a third party to provide you with goods or services, With Love do so on the basis that With Love do not accept any liability whether in contract, equity, tort (including negligence), an enactment or otherwise in relation to that assistance or recommendation.

  • The performance of requirements under any contract entered by you as the client will not bind With Love to the terms of that contract. However, With Love may, from time to time, be required to performed and/or manage contracts if necessary. When oversight and/or management is required, you will be made aware of the specific management and/or oversight details required by With Love to ensure the wedding day progresses as planned. To avoid any doubt, With Love will assist, but you (as the client and as a party to that contract) will remain liable in full under the terms of the contract(s) which you have signed.

  • You as the client will make direct payments to the service provider and NOT to With Love.

 

Assignability

  • This contract is not assignable without prior written consent of With Love.
